Earned leave rule for teachers

Calculation of earned leave in case of the employee serving in a vacation department                               
                            In our previous topic of Earned leave calculation, we had learned how earned leaves are calculated and had done a practical example also. That method of earned leave calculation is for employees other than the employees of the vacation department like teachers.
                    Earned leave calculation in case of teachers means vocational department employee is totally different from other department employees. In this topic, we will learn, how earned leaves are calculated in the case of vocational department employees like teachers, Head masters, and Principals, etc.

Civil Service Rule for taking earned leave

            As per rule 8.117 of Punjab Civil Service rules volume 1 part 1, A Government employee serving in a vacation department shall be entitled to earned leave of eight days for every completed year spent on duty.

            Whereas in the case of other employees earned leave is admissible as per rule 8.116 and is calculated by period spent on duty. This means there is no restriction of the completed year.

           

When an employee is prevented from availing himself of the vacation

            When any the employee is prevented from availing himself of the vacation then earned leave shall be admissible for that period.

             Let’s see how earned leave become admissible to an employee who is prevented from availing himself of the vacation:-

In the case of Full vacation                                            

                        As per the first proviso under rule 8.117, if in any year, an employee is prevented from availing himself of the full vacation, earned leave shall be admissible to him in respect of that year in accordance with the provisions of Rule 8.116. For better understanding see the practical example.

In the case of Part of a vacation

                        According to the second proviso under rule 8.117, if in any year, an employee is prevented from availing himself of a part of vacation, the earned leave proportionately admissible to him under sub-rule (b), together with earned leave of eight days admissible under this sub-rule, shall not exceed the maximum earned leave admissible under rule 8.116. To clear this concept see the practical example provided below:-


Practical example

                        Calculate earned leave admissible to a Government employee as on 01-01-2011 who joined as a Punjabi teacher in a vacation Department on 01-01-1990 from the following particulars:-

(i) Preventing from availing vacation of 12 days out of 45 days of total vacation in 1994.

(ii)Preventing from availing vacation of 10 days out of 40 days of total vacation in 1996.

(iii) Availed 5 days earned leave from 16-05-1998 in 1998.

(iv)  Prevented from full vacation in 2002.

(v)    Availed 10 days earned leave from 9-7-2003 in 2003.

(vi)  Availed 8 days earned leave from 1-10-2008 in 2008.

                  Hence the total earned leaves at the credit of an employee on 01-01-2011 is 165.

    Kindly clear the rule vide which rounding of the leave earned to 64 days is done in the year 1996, please.
